L-W Children [2019] EWCA Civ 159: interesting case of “fact-finding hearing” (fact-finding hearings are used to decide important issues that are in dispute between the parties or to find out what happened on an occasion). In this case, the court had made a finding that the mother’s failure to protect the children arose from her permitting her partner to care for the children alone, given that she knew, or ought to have known, certain facts which had occurred outside the home in relation to his violent behaviour. The Court of Appeal overturned that finding, on the basis that there was no evidence which could properly lead to a finding that the mother had failed to protect her children.
