GUIDANCE ON THE USE OF INTIMATE IMAGES WITHIN PRIVATE LAW CHILDREN PROCEEDINGS

In a recent case the judge has provided important information and guidance on the use of intimate images and how those images should be dealt within private law children proceedings, for example:


  • intimate images should not be filed without a written application, which should be considered at a case management hearing;


  • that the party making the application needs to persuade the court of the relevance and necessity of such material to the specific factual issues which the court is required to determine;


  • that the court should carefully consider the relevance of the intimate images to the issues of the case with the probative value of the evidence;


  • that if admission of intimate images is permitted, the volume should be limited to what is necessary and the court will determine who can view the images;


  • if the evidence is considered relevant, the starting point should be to incorporate the lowest number of images to be seen by as few people as necessary; and etc.
