We are back at the free legal advice service. We have just been assisting someone who has had a horrendous time appealing a DWP PIP decision and we know this is a difficult area and people get very overwhelmed and we are going to post various information today to help people to understand the appeal process and to know that as overwhelming as it may be you need to fight to ensure that you are provided with the correct level of award that you are entitled to, though we understand that it is difficult to fight when you are battling with pain and possibly financial issues arising as a result of your condition .


So here are some simple rules.



  1. When you get your decision back if it refers to correspondence from GP's or Consultants double check that


indeed those letters are in your GP's etc files. We have come across situations where data from another person's file has been mixed up with another applicants, this is of course a breach of the GDPR Rules but initially may affect your entitlement.



  1. Underneath the IAS rules you can record interviews however you need to obtain permission and we will be posting a copy of the letter you need to use. We really would recommend you do this if possible, even if you have to hire the recording equipment, there are numerous recording studios on google that hire out such equipment, remember to back up your recordings and transcribe the interviews

  2. Make sure that you put everything in writing, or you record your phone calls and then transcribe them. You need to inform whoever you are speaking to that you recording the conversations.

  4. Did you know that as of August 2018 new guidance, regarding PIP awards came into force and we will provide the link for this.
