HOMEOWNERS SUCCEED IN DEFECTS CLAIM AGAINST CONTRACTOR

If you are having problems with a contractor who you believe has breached the contract, you must read this case. The court’s decision made it very clear the following points:


  1. The importance of carefully reading and complying with contractual notice provisions. 

  2. Take photographs of every stage of the contractor’s work.

  3. Obtain the advice from remedial works contractor and their independent expert.

  4. Clearly stipulate in the contract what works you expect to be taken and the costs involved.

  5. If there are any changes, make sure that these are agreed in writing.

  6. Keep clear evidence of damages flowing from the breach of contract.
